Kyung (Kathryn) Dickerson and Alan Plevy, Family Law attorneys at SmolenPlevy say this all depends on the conditions outlined in their prenuptial agreement. The money they made together on their wedding day special might be split down the middle–but only if the pre-nup directly addresses this issue. If not, the two could be hashing it out for months.
Sources say that Kim’s mother, Kris Kardashian, insisted the couple get a pre-nup to keep their assets separate. “Couples marry for richer or poorer,” says Dickerson. “But when one is significantly richer than the other, parents often insist on a prenup.” This is certainly the case in this situation, where Kardashian is worth more than $35 million, while Humphries pales in comparison with a net-worth of $8 million.
Dickerson and Plevy say this issue sheds light on the necessity of pre-nups in marriages today. Without one, ex-spouses may end up battling it out in Court: a long, drawn-out process that no one wants to endure alongside the stress of a divorce.
The premarital agreement often forces young couples to discuss the uncomfortable issues, which they might otherwise have ignored. “A couple might adopt a pet while they’re living together, and figure out what will happen in case they split,” says Dickerson. “But they
won’t talk about finances, children, religion and other important topics. A prenup, no matter who brings it up, opens the door to those conversations.”
The fact of the matter is: all couples should attain a pre-nup–not just the wealthy. The document is not only applicable in the case of divorce, but will help to protect each party in the case of separation or death.
